EU Data Act Declaration

Introduction

The EU Data Act (Regulation (EU) 2023/2854) came into force on January 11, 2024, with most provisions applying from September 12, 2025. It grants consumers and businesses greater control over data generated by their connected devices, aiming to foster a fair and innovative data economy. Key provisions include user rights to access, use, and share data from connected products, fair data sharing terms, and rules on using data.

Declaration

Our products and services offered on this website, with the sole exception of the SIMULand.v4 application, do not generate, collect, or process any data that falls under the scope of Regulation (EU) 2023/2854 on harmonised rules on fair access to and use of data (Data Act).

The SIMULand.v4 application is an exception, and all data generated and processed within it are handled in full compliance with the Regulation as mentioned above and other relevant data protection laws.

How SIMULand.v4 handles data

(in line with the EU Data Act – Regulation (EU) 2023/2854)

During regular operation, SIMULand.v4 does not send data to the manufacturer or third parties.
Data is only transmitted if the user voluntarily sends a crash report or feedback through the application.

What data may be transmitted?

If the user decides to send a crash report or feedback, the following information may be included:

  • User message (optional, only what the user writes)
  • Crash report (error log/stack trace): Technical information about the error may include file paths from the user’s computer.
  • User contact details (optional, e.g., email address if provided)
  • Application version (always)
  • Timestamp of submission (always)
  • Public IP address (always, automatically generated by the internet connection)

Purpose of processing

The collected data is used exclusively for:

  • Diagnose and resolve technical issues.
  • Improve the stability and performance of the application.
  • Contact the user if they provide contact details.

Access to data

  • Access to submitted data is restricted to the SIMULand.v4 development team.
  • Data is not shared with third parties unless the user has given explicit consent or if required by law.

Data retention

  • Crash reports and feedback are stored only as long as necessary to analyse and resolve the issue, and for no longer than 12 months.
  • After this period, the data is securely deleted.

User rights:

Users have the right to:

  • Request access to the data they submitted.
  • Request correction or deletion of their data.
  • Restrict or object to processing.
  • Complain to the competent supervisory authority (in the EU: Data Protection Authority).

Voluntary submission

Sending an app crash report or feedback is entirely voluntary. The application works fully without doing so.
